ACLF Regulatory Update

 

The timeline for implementing new rules and regulations for Assisted Care Living Facilities was unexpectedly delayed this week at the Board of Licensure for Health Care Facilities Committee Meeting (BLHCF). 

 

TNAHSA has been actively involved in this process, at the request of the subcommittee assigned to draft the new rules. Serving on the committee and as an advisor in the process, we were anticipating heavy discussions at the meeting concerning civil monetary penalties and admission criteria, particularly for those residents receiving hospice care. The discussions were tabled, however, due delayed reviews of the drafts from the Deputy General's office. According to attorneys with the DOH, the process will now be to submit revised drafts to the subcommittee, including TNAHSA, and the full BLHCF board in December. The Board will then vote on approval of the drafts via conference call. From there, the rules will go into rulemaking process through Public Necessity process. This will mean the rules will become active immediately upon signature by the Secretary of State. The Department of Health did state that during this time they will also engage in a regular rulemaking process where there is opportunity for public comment, since the public necessity rules are only effective for 165 days.

 

Bottom line for Assisted Living Communities is that new rules are in the process of being developed. TNAHSA has represented your interests through this process. We are concerned with the issues of civil monetary penalties and admitting criteria. Other areas of concern have been thus far resolved to acceptable practice, which includes medication administration and evacuation procedures. We will be reviewing these new rules in depth with members and attendees during the Senior Symposium, December 9-10.

Assisted Living Regulatory Subcommittee Formed


The Board of Licensure for Health Care Facilities recently named a subcommittee to review rules and regulations for assisted care living facilities. The subcommittee will be responsible for implementation of changes to the current rules related to the passing of the Long Term Care Community Choices Act. TNAHSA has been asked to be an advisor in this process. We appreciate any comments or feedback from membership on this very important issue.
